Big Win For Forced Reset Triggers

Welcome to the Live To Shoot podcast. My name is Jeff Dole. I've been a licensed firearms dealer for the last 18 years in this podcast to talk about all things related to Second Amendment, as well as anything else going in the world, a sports story, or. Anything else you might find interesting. So welcome, welcome, welcome. So before we dive into it, first off, I will want to just say my stars. Let me down last night. And I. I don't know what to say. They didn't play well, they did not play well at all. And we have to look next year and see what they need to do to be able to beat Edmonton. That's all I can say about that. And we will move on. I wish I could say, Hey, I hopeful that the Cowboys will be able to ease this pain, but I don't think that's gonna happen as well either. Also, before we start, I wanna just reflect back a year ago, just think back where we were a year ago, a year ago. President Trump was being found guilty on 36 charges in New York. He was, this is back, he was sitting in courtrooms. Remember we had the document case in Florida. We had the Fannie Willis case. We had the Jack Smith case. We had this case about the campaign contribution and that he was found guilty on, and the left was certain they were gonna be. Putting him into jail and that he was not gonna be. And they were in fact, you know, Biden has come out and said, our people have reported that Biden was pretty confident that Trump was going to jail and that he was gonna win. Have we come a long way? We are getting our freedoms back. The borders closed. The second Amendment is being defended and things are just lining up the way that we would hope. But, and this is another story we wanna talk about. So, yes, this is the Live to Shoot podcast and we've got a lot that we wanna talk about. But the big thing I'm talking about today is the Department of Justice just dropped a, a bombshell settlement with rare breed triggers ending their ban on forced research. Forced to reset triggers fts for short. It's huge folks, and we're gonna break it down, celebrate the win and talk about what it means. So let's get to it. Patriots, let's set the stage. So for years the A TF has, been waging war on forced reset triggers. Now, these are aftermarket devices that let your AR 15 style rifle fire faster by mechanically resetting the trigger after each shot. Now, let's. Always be clear on this left who's going crazy. These are not machine guns. Each shot still requires a separate trigger pull, but under the Biden administration, the A A TF decided to play again, fast and loose, and they classified f RTS as machine guns under the NFA. And they went after manufacturers like rare breed triggers, sued them, seized their products, and even threatened law abiding gun owners with federal prison for owning what was essentially a fancy trigger. So. Those thugs were knocking on doors and confiscating legally purchased property, all because the a TF thought that they could rewrite the law without Congress. So sounds like some of the typical governmental outreach that we've been dealing with, but. Now we've got the DOJ under president Trump and attorney Pam Bondy, and they're, they've been putting breaks to this kind of stuff. So on May 16th 2025, they announced a settlement with rare triggers that ends the ban on F rts, requiring the AF to return the cc. Ceases triggers and sends, sends a clear message that Second Amendment is not a second class. Right? So again, let's break it down. The settlement comes on the heels of some other major legal wins for the Second Amendment back in 2024. The Supreme Court ruled in Cargill v Garland that the A TF overstepped its authority by classifying bump stocks as machine guns. See the, the common theme here, that decision set the stage for a federal judge in Texas to apply the same logic to F RTS in July, 2024, saying they don't meet the legal definition of machine gun either. Why? Because a machine gun under the law requires multiple rounds with a single function of the trigger. Fr Ts. They require trigger pull for every shot. Pretty simple. You pull the trigger and a bunch of rounds go firing off. That's machine gun. Pull the trigger. One bullet goes out. That's a semi-automatic or a rifle. So the a TS, you know, argument was flimsier than anything. So now rare breed triggers along with groups like the national association for Gun Rights and Texas Gun Rights. Didn't just roll over, they fought back in court and they had some heavy hitters on their side. The result, the DOG, the DOJ is dropping three lawsuits against rare Berry triggers, dismissing the appeals in the second fifth circuit, and agreeing not to enforce machine gun regulations against F rts for AR style rifles. And if you have your frt seizes or surrendered it it under pressure from the a TF, you can request request its return by September 30th, 2025. You can check out the ATFs website and they've got information on how you can go about getting that back. I wouldn't hold my breath. It's gonna take a while. Even in the new administration, the A TF is still the A TF. So now why does it matter? Second Amendment, as we always say, isn't about hunting and sports shooting. It's about ensuring we the people have the means to defend themselves. I. They don't including typical governments, fts, don't turn a rifle into a machine gun no matter what. The gun grabbers at Giffords say, VA. Vanessa Gonzalez from Giffords had the audacity to claim the settlement effectively legalizes machine guns and that lives will be lost. The, that is what the left is just minds are blown because they they just don't understand. They don't ever take the time to understand just because a gun can fire fast. Hey, have you ever seen Jerry Ick fire a revolver? I mean, it's amazing. You would think it's a machine gun, but it's just that somebody manually pulling a trigger. So just because you can fire fast doesn't mean it's a machine gun. These fts, they've been around forever and I. You know, you go back to 2 20 17 and Las Vegas shooting involved, bump stocks, not frt. And even then, the answer isn't to strip law abiding citizens with the rights. It's about enforcing the law and addressing the root costs of violence, not demonizing the tools. I. Lawrence Damco, he's the president of Rare Breathe, said at best, the victory is a landmark mo moment in the fight against unchecked governmental overreach. The A TF and DOJ tried to silence and bury us, not because we broke the law, but because I refused to bend to the will of tyrannical administration. Aim into that. Lawrence and this settlement isn't just about triggers. It's about sending up a, a, a message to the bureaucrats that who think that they can rewrite the law and anti fit in their anti-gun agenda. So there's part of this that we gotta be real about. There is a catch. We agree, agree to develop frt, agree not to develop fts for handguns and enforce their patents against competitors, including folks 3D printing their own triggers. Some folks on x and are calling this the deal with the devil saying rare breed. Basically be, I mean the DO G'S patent troll to limit who can make FFR Ts, but I hear the concern, but let's keep perspective. Rare breed was fighting for survival against a Biden a TF that wanted to crush'em. This still get, gets frt back on the market and triggers return to owners. It's not perfect, but it is a step forward. So. Here's my take Rule fight isn't just about f rts, it's about dismantling the a TS ability to make up rules as they go. The cargo ling and the settlement show, the courts are starting to check the a TS power, but we still need Congress to step up. Then the NFAs definition of machine gun is clear, but it's also outdated. Some folks on Reddit suggest updating it too. In closing loopholes, like defining a machine gun is firing multiple rounds. Why don't we just get rid of the a, the NFAI think that's a, but that's a whole other conversation. You know, we we're getting closer, we're getting silencers out, but you know, NFA is outdated entirely anyway, and we need to just be done with it and stand up and fight for our second, right? So. Gun control. You know, you know, but the gun control advocates, they, they're still losing their mind. Michigan ag Dan Nessel and a coalition of 16 Anti-Gun attorneys, attorney Generals tried to intervene in the fifth Circuit to keep the FRT ban alive, wi whining that these devices turned them into military machine guns. Sorry, Dana, but the law doesn't bend to your feelings. The Fifth Circuit dismissed the appeal and the DOJ settlement shut the door on their crusades. And let's not forget the bigger picture, Trump's executive order on protecting the Second Amendment rights issued on his second day in office. Set the tone, Pam Be's team, including Emily Beau, who reviewed the ATFs actions and said, enough is enough. Even when ATFs own chief counsel, Robert Lider argued our F RTS posed a public safety threat. The DOJ prioritizes the law over bureaucracy, and that's what we need leadership that respects the Constitution. So. What's next? We gotta keep fighting. If you had your F RTCs, get on the A TSW web website and request its return before September 30th, 2025. Don't let the government keep your property. Second. Support companies like Rare breeded and groups like NAGR and SEC Texas Gun Rights. They're out there fighting legal battles and stay diligent. The a TF is still out there and, you know, they're reviewing scheme ways to chip air rights where we're going down the right path. This new DOJ seems to be in line with trying to protect the second Amendment, but you never know where things might go and. We always have to keep fighting and stay diligent because right around the corner could be a new administration. So that's it for today. Thank you for listening.
