Well, welcome to the Live to Shoot podcast. My name is Jeff Doll. I've been a licensed firearm to doula for the last 18 years. In this podcast, we talk about. All things related Second Amendment, as well as anything else going in the world, a sports story or anything else that I might find interesting. So welcome, welcome, welcome. So been a beat since I did an episode. Things have been just a little crazy around here. Been a little out of outta my routine. Some things, you know. Have transpired in all honesty. Along with that and the Charlie Kirk assassination just been a little off and haven't really been able to get back into the groove again. But, but here we are, we're sitting down recording something that I'm, should have talked about last week when this really developed. But it's, it's such a big thing. At least it's always been one of these things that's been on my radar that I wanted to talk about and, and. And what is that? Well, we got a massive victory just last week. And what we're talking about is a recent ruling in the Firearms Policy Coalition Inc. Et all versus Bondy. There's, this is where a federal judge just struck down the ridiculous ban on, on carrying firearms and post offices and on postal property, and if you ever like felt like big governments turning every corner of your public life into a gun free zone. Well this one's for you. So let's break it down. So first, here's the quick backstory on the case, the Firearms Policy C Coalition, and those guys do great work. Along with the Second Amendment Foundation. Another great group and a couple Texas citizens. Gavin Pate and George Mandri filed a lawsuit back in 2024. These guys just like you and me, law abiding folks, conceal carry license, who wanted to exercise their right to self-defense anywhere they go including when they were dropping off packages or buying stamps. But no, the Fed said not in our post offices. And so they were challenging two key pieces of, of regulation. The US Postal Regulation from 1972. That bans firearms on any postal property, including parking lots and a, and a federal statute 18 USC nine 30 a, which makes it a crime to possess a gun in federal facilities like post offices. And you violated and you're looking at jail time or fine. Cr crazy, right? The defendant, well it was originally a, it was Merrick Garden Garland and now you know it went to Pam Bondy and has heard role as Attorney General and you know, yes, things change at the top. The fight stays the same. These plaintiffs argued that this blanket ban violates the Second Amendment, especially in light of the Supreme Court Bruins decision back in 2022. For those who need a refresher. Bruins said that any gun regulation has to pass a history and a tradition test. The government can't just make up rules. They have to show that similar restrictions existed when the Second Amendment was ratified in 1791, and this is where it gets good. Chief Ju district Judge Reid O'Connor in the Northern District of Texas, God bless Texas, handed down this ruling at the end of September, just, you know, a few weeks ago, and he applied the room test just like a hammer. Step one, does the Second Amendment cover carrying her firearm for self-defense in a post office? Absolutely. It's presumptively protected. Step two, can the government prove that this ban lines up with any of our nation's historical traditions? Nope. Not even close. Judge O'Connor pointed out that post offices have been around since before the founding. Ben Franklin was the first postmaster general in 1775 for crying out loud. And there were threats in the mail back then, like robberies and disruptions, but did the founders ban gun and post offices? Nope. They didn't even think about it. The first Royal Federal building, federal Building, gun bans didn't show up until the 1960s, and the postal specific one was in 1972. That's way too late to count. As a tradition, the government tried to argue that post offices are sensitive places like schools courthouses or polling places where Rahimi and Bruin say some restrictions might, might apply, but the judge shut that down. He said Post offices aren't doing heavy duty government business like trials or elections. They're just places where regular folks handle everyday mail. No historical analog means no ban. They even tried, that this the lame property own argument that the government owns the building so they can do what they want under property clause or post office clause. Judge O'Connor, he wasn't having it. The postal service is still a government actor bound by the Constitution. You can't just wave away the Second Amendment because you own the dirt under the building. Boom. Unconstitutional as applied to carrying firearms in ordinary post offices and their property. We're talking your standard neighborhood post office, not ones on military basis or on restricted federal complexes. And the final hammer to drop the court granted summary judgment to the plaintiffs, denied it to the government and issued a permanent injunction. That means the feds can't enforce this ban against FPC members or the in individual plaintiffs in these ordinary post office. It's a targeted wind, but it's a crack in the armor of all these arbitrary gun zone. So folks, this is huge. It shows that post Bruin. The courts are finally holding the line against overreach. No more treating law abiding citizens like criminals just for wanting to protect themselves while picking up the A certified letter. Imagine the implications if post offices aren't off limits. What about other public spaces? The Antis love to disarm Sin Parks, libraries. This ruling reinforces the Second Amendment. Isn't a second right class, right? Second class, right? It's absolute. And the burden is on the government to justify the infringement. Of course, you are gonna expect appeals. The Biden era holder ofs or whoever's left in the DOG might fight this tooth and nail. But I don't know, with Bondy at the helm, who knows? Either way, it's a reminder. Join groups like FPC or S-A-A-F-A support these lawsuits and stay legitimate.
